According to Indian law, the parties to the lawsuit or appeal may have the right to seek for the transfer of the lawsuit from one state to another through a lawyer. Only in the event that the court determines that a transfer is required in the interest of justice will the petition for transfer be granted. The CPC contains provisions that allow the court the authority to consider the petition.
The term “transfer of petition” describes moving the case from one state or city to another. The Transfer Petition is submitted to the High Court when the matter needs to be transferred within the state.
If the case needs to be moved from one state to another, a Transfer Petition should be filed with the Supreme Court since in such a situation, the Supreme Court has the authority to move the case.
CPC Section 25: The petition can be moved from a High Court or other Civil Court in one State to a High Court or other Civil Court in any other State, according to the statement. This is possible on a party’s request, and if the Supreme Court finds it necessary after hearing from both sides, it may transfer the petition to make it more convenient for the party to receive justice. In a number of rulings, the court permitted the transfer of the case in order to ensure that the parties were treated fairly.
CrPC’s Transfer Provision: The Criminal Procedure Code of 1973’s Chapter XXXI, from Sections 406 to 411, contains the provisions relating to the transfer of cases. In order to ensure that the party receives justice, Section 406 of the Code of Criminal Procedure, 1973 gives the Supreme Court the authority to transfer cases, petitions, and appeals that are pending in one High Court to another High Court or from a criminal court subordinate to one High Court to another criminal court of equal or superior jurisdiction subordinate to another High Court.
